TERMS AND CONDITIONS OF SERVICE
M-TECH AUTO INC ("M-TECH", "we", "us", "our") provides mechanical repair, diagnostic, maintenance, body repair, refinishing, alignment, and related automotive services. These Terms and Conditions ("Terms") apply to all services performed by M-TECH AUTO INC. By authorizing work or leaving a vehicle with us, you agree to be bound by these Terms.
1. Estimates and Authorization
- All estimates are provided in good faith based on visible conditions and information available at the time of inspection.
- Estimates are not guarantees. Additional repairs may be required due to hidden, underlying, or previously undisclosed conditions.
- Customer authorization is required before work begins. Authorization may be provided in writing, electronically, or verbally.
- If additional work is required beyond the original estimate, M-TECH will make reasonable efforts to obtain customer approval before proceeding.
2. Payment Terms
- Payment is due in full upon completion of services, unless otherwise agreed in writing.
- Accepted payment methods include cash, debit, credit card, or other methods approved by M-TECH.
- A deposit may be required for special-order parts, engine replacements, body repairs, or extended work.
- Vehicles will not be released until full payment is received.
- Outstanding balances may be subject to interest at the maximum rate permitted under Ontario law.
3. Parts and Materials
- Parts may be OEM (Original Equipment Manufacturer), aftermarket, remanufactured, used, or performance-grade, as agreed with the customer.
- Special-order parts are non-refundable once ordered.
- M-TECH is not responsible for delays caused by parts availability, supplier issues, or manufacturer backorders.
4. Mechanical Repair Services
- Mechanical repairs are performed to manufacturer specifications or agreed upgraded standards.
- M-TECH is not responsible for failure of unrelated components before, during, or after service.
- Older or high-mileage vehicles may experience additional failures due to normal wear and tear.
- Diagnostic results are based on available data and testing methods and do not guarantee identification of all faults.
5. Body Repair and Refinishing
- Body repairs may involve structural, cosmetic, and refinishing work.
- Colour matching is performed using industry-standard paint systems; exact colour match is not guaranteed, especially on aged or sun-faded vehicles.
- Body repair timelines are estimates and may be affected by parts availability, insurance approvals, or supplemental damage discovery.
- M-TECH is not responsible for pre-existing corrosion, prior poor repairs, or hidden damage not visible at initial inspection.
6. Alignment, Suspension, and Performance Services
- Wheel alignments are performed using professional alignment equipment to OEM or customer-requested specifications.
- Performance alignments, suspension modifications, and non-OEM settings may increase tire wear, noise, vibration, or reduced ride comfort.
- The customer accepts full responsibility for the effects of modified suspension geometry or performance settings.
7. Fluids and Maintenance Services
- All fluid services are performed using OEM-approved or upgraded-spec products suitable for the application.
- M-TECH is not responsible for failures caused by pre-existing internal engine, transmission, or drivetrain conditions.
- Maintenance services do not reset or extend manufacturer warranties unless explicitly stated.
8. Warranty
- M-TECH provides a limited warranty on labour only, unless otherwise stated in writing.
- Parts warranties are subject to the manufacturer’s warranty terms.
- Warranty does not cover:
- Normal wear and tear
- Misuse, abuse, racing, or track use unless explicitly agreed
- Modified or non-OEM applications
- Failures caused by other components
4. Warranty claims must be reported promptly and inspected by M-TECH before repairs are performed elsewhere.
9. Storage and Abandoned Vehicles
- Vehicles not collected within 5 business days after service completion may be subject to storage fees.
- Storage fees will be charged at a daily rate communicated to the customer.
- Vehicles left unpaid or unclaimed may be deemed abandoned and dealt with under the Ontario Repair and Storage Liens Act (RSLA).
10. Limitation of Liability
- M-TECH shall not be liable for indirect, incidental, or consequential damages.
- Liability is limited to the amount paid for the specific service performed.
- M-TECH is not responsible for loss of personal items left in the vehicle.
- M-TECH is not responsible for delays or damages caused by events beyond reasonable control, including supplier delays, weather, or acts of God.
11. Test Drives and Vehicle Operation
- Customer authorizes M-TECH employees to operate the vehicle for testing, diagnostics, and quality control.
- Vehicles may be driven on public roads where reasonably necessary.
12. Governing Law
- These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
- Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.
13. Acceptance of Terms
By authorizing service or leaving a vehicle with M-TECH AUTO INC, the customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
